It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Email address
  • First name and last name
  • Password — if You register with an email and password rather than through Google, Your password is stored as a salted hash. We never store or have access to Your password in plain text.

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol (IP) address (e.g. Wi-Fi), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Information from Third-Party Social Media Services

The Company allows You to create an account and log in to use the Service through the following Third-party Social Media Service:

If You decide to register through or otherwise grant us access to a Third-Party Social Media Service, We may collect Personal data that is already associated with Your Third-Party Social Media Service's account, such as Your name, Your email address, Your activities or Your contact list associated with that account.

You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service's account. If You choose to provide such information and Personal Data, during registration or otherwise, You are giving the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

Account data is retained for as long as your account remains active and for up to 90 days after account deletion to allow for account recovery. Usage analytics data is retained for up to 24 months. After these periods, data is permanently deleted or anonymised.

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security. All data in transit is encrypted via HTTPS/TLS. Access to personal data is restricted to authorised personnel only.

Sub-processors and International Data Transfers

We use a small number of service providers to run Labeliy. Each processes personal data only on Our instructions and only for the purpose listed below:

  • Vercel Inc. (USA) — hosts the Labeliy application and web infrastructure.
  • MongoDB, Inc. (MongoDB Atlas) — our primary database, storing account, session, and saved label-design data.
  • Supabase, Inc. — stores uploaded images and label configuration data.
  • Google LLC (USA) — provides Google Sign-In as an optional login method.
  • PostHog, Inc. (USA) — provides product analytics and, where enabled, session replay. Only loaded after You accept analytics cookies — see Cookie Settings.
  • Google Analytics (Google LLC, USA) — website analytics. Only loaded after You accept analytics cookies.

Some of these providers may process or store data outside of Your country, including in the United States. Where We transfer personal data of EU/EEA or UK residents to a country without an adequacy decision, We rely on Standard Contractual Clauses (or an equivalent safeguard offered by the provider) to protect that data. Your Rights Under GDPR (EU/EEA Users)

If You are located in the European Union or European Economic Area, You have the following rights under the General Data Protection Regulation (GDPR):

  • Right of Access — You have the right to request a copy of the personal data We hold about You.
  • Right to Rectification — You have the right to request correction of inaccurate or incomplete personal data.
  • Right to Erasure (“Right to be Forgotten”) — You have the right to request deletion of Your personal data, subject to certain legal exceptions.

Your Rights Under UK GDPR (UK Users)

If You are located in the United Kingdom, Your personal data is protected under the UK General Data Protection Regulation and the Data Protection Act 2018, as administered by the Information Commissioner’s Office (ICO). Your rights under UK GDPR are the same as those listed above for EU/EEA users — access, rectification, erasure, restriction, portability, objection, and withdrawal of consent — on the same legal bases. Your Rights Under the CCPA/CPRA (California Users)

If You are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), gives You the following rights:

  • Right to Know — You may request the categories and specific pieces of personal information We have collected about You, and the categories of sources, purposes, and third parties involved.
  • Right to Delete — You may request deletion of personal information We have collected from You, subject to certain legal exceptions.
  • Right to Correct — You may request correction of inaccurate personal information We hold about You.
  • Right to Opt Out of Sale or Sharing — We do not sell Your personal information, and We do not share it for cross-context behavioral advertising. If that ever changes, We will update this policy and provide an opt-out mechanism first.
  • Right to Non-Discrimination — We will not deny You service, charge different prices, or provide a different level of quality because You exercised a CCPA/CPRA right.

We automatically honor the Global Privacy Control (GPC) signal as a valid opt-out request — if Your browser sends it, We disable analytics and marketing cookies for You without any further action needed. Your Rights Under India’s Digital Personal Data Protection Act (DPDPA) 2023

If You are located in India, Your personal data is processed in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA). As a Data Fiduciary, Labeliy is committed to the following obligations:

  • Lawful Processing — We process Your personal data only for the purposes for which You have given consent or for other lawful purposes permitted under the DPDPA.
  • Right of Access — You have the right to obtain a summary of the personal data We hold about You and information about the processing activities.
  • Right to Correction and Erasure — You have the right to correct inaccurate or misleading personal data and to erase personal data that is no longer necessary for the purpose for which it was processed.
  • Right to Grievance Redressal — You have the right to a readily available means of grievance redressal. We will acknowledge and resolve grievances within a reasonable timeframe.
  • Right to Nominate — You have the right to nominate another individual to exercise Your rights under the DPDPA in the event of Your death or incapacity.

We collect Your consent before processing personal data and provide clear notice of the purpose of such processing. You may withdraw Your consent at any time; however, withdrawal does not affect the lawfulness of processing prior to the withdrawal.

Your Rights in Other Jurisdictions

Labeliy has users outside the EU/EEA, UK, USA, and India as well. Wherever You are, We apply the same baseline: We collect only the personal data described in this policy, use it only for the purposes stated, and honor the following rights, which are recognized in some form by most data-protection laws worldwide — including Canada’s PIPEDA, Brazil’s LGPD, Australia’s Privacy Act 1988, and Singapore’s PDPA:

  • Access — know what personal data We hold about You.
  • Correction — have inaccurate personal data corrected.
  • Deletion — request that We delete Your personal data, subject to legal exceptions.
  • Withdrawal of consent — withdraw consent for anything We process on that basis, at any time.

Children’s Privacy

Our Service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, We take steps to remove that information from Our servers.

Changes to This Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and updating the “Last Updated” date. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
